Terms of Service

1. Acceptance of Terms
By accessing or using FitCheq (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and creators.
FitCheq reserves the right to update these terms at any time. Continued use of the Service after changes constitutes your acceptance of the revised terms.
2. Eligibility
You must be at least 13 years old to use FitCheq. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these terms on your behalf.
3. Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and current information when creating an account.
- You may not create accounts for others without their consent.
- FitCheq may suspend or terminate accounts that violate these terms.
4. Creator Terms
Content ownership
You retain ownership of the outfit photos and content you post. By posting on FitCheq, you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote your content within the Service.
Affiliate programme
Creators who join the affiliate programme agree to the following:
- All outbound product links are routed through FitCheq affiliate infrastructure.
- Commissions are calculated based on eligible clicks and purchase conversions as tracked by our systems.
- FitCheq retains a platform share of affiliate commission; creator earnings are paid on the schedule described in the Creator Dashboard.
- Self-clicks (clicking your own links) do not count toward earnings.
- FitCheq may adjust commission rates with 30 days' written notice.
Content standards
Creators must not post content that:
- Infringes third-party intellectual property rights.
- Is sexually explicit, violent, or harmful.
- Includes false or misleading product information.
- Violates any applicable law or regulation.
5. Prohibited Conduct
You agree not to:
- Scrape, crawl, or extract data from FitCheq without written permission.
- Attempt to circumvent or manipulate the affiliate attribution system.
- Impersonate another person or entity.
- Post spam, malware, or unsolicited commercial content.
- Use the Service for any unlawful purpose.
- Interfere with or disrupt the Service or its servers.
6. Intellectual Property
The FitCheq name, logo, design, and all platform-created content are owned by FitCheq and protected by intellectual property laws. You may not use our trademarks or branding without prior written consent.
7. Third-Party Links and Services
FitCheq links to third-party merchant platforms (Shopee, Lazada, and others). We are not responsible for the content, policies, or practices of those platforms. Your use of third-party platforms is governed by their own terms of service.
8. Disclaimers
FitCheq is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for the accuracy of product prices, availability, or descriptions shown in creator posts.
9. Limitation of Liability
To the fullest extent permitted by law, FitCheq shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of earnings, data, or business opportunities.
10. Termination
Either party may terminate the relationship at any time. You may delete your account through the app settings. We may suspend or terminate your account for violations of these terms, with or without notice.
Upon termination, your licence to use the Service ends. Sections on intellectual property, disclaimers, and limitation of liability survive termination.
11. Governing Law
These terms are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
